Terms of Service

1. Acceptance of Terms

By accessing or using Scavenger AI (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. Scavenger AI is operated by Scale Ventures LLC, a limited liability company organized under the laws of the State of Michigan, United States ("Scale Ventures," "we," "us," or "our").

2. Service Description

Scavenger AI is a clearance and deal-hunting tool operated by Scale Ventures LLC. It aggregates pricing, inventory, and product information sourced from third-party retailers — including Home Depot and other supported stores — and presents it through search, deal feeds, penny detection, real-time monitors, watchlists, free-food offers, and reports.

We do not sell products, process retail transactions, or control retailer pricing, inventory, store policies, or employee behavior. Scavenger AI is not affiliated with or endorsed by the retailers or brands listed within the Service unless explicitly stated. Retailer names and logos are used for identification purposes only.

3. Accuracy and Availability Disclaimer

Retail data is volatile. Prices, stock levels, store locations, clearance statuses, penny-status indicators, and free-food offers displayed in Scavenger AI may be inaccurate, incomplete, outdated, or unavailable at any given moment.

You are solely responsible for verifying pricing, availability, and purchase terms directly with the retailer before making any purchase decisions or traveling to a store. Scavenger AI provides this data for reference purposes only.

4. User Responsibilities

By using Scavenger AI, you agree that:

• You will verify any information before making purchasing or travel decisions.
• You will use the Service lawfully and respectfully.
• You will not scrape, harvest, mirror, reverse-engineer, or otherwise abuse the Service's APIs, data, infrastructure, or entitlement system.
• You will not share your account, sell access, or attempt to circumvent paywalls, rate limits, or subscription tiers.
• You will not automate the Service, run bots against it, or use it to harvest data for resale.
• You will behave respectfully toward retail employees and other shoppers when acting on information from Scavenger AI. Penny items, clearance prices, free-food offers, and similar deals are subject to individual store policies and employee discretion. Do not show the app to employees, film them, harass them, or cause scenes.
• You will not publicly expose live penny items, monitor data, or other time-sensitive information outside any permitted sharing guidelines posted by Scavenger AI or the Scale Ventures community.

5. Accounts and Authentication

To use Scavenger AI you must create an account. We may offer registration and sign-in through third-party providers (such as Google or Discord) in addition to or instead of email-based credentials. By signing in through a third-party provider, you authorize us to receive the basic profile and identity information needed to authenticate you and determine your entitlements.

• One account per person. No shared logins.
• Access to certain features may be gated by subscription tier and/or community membership.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• If you sign in through a third-party provider, you must comply with that provider's terms; loss of that account may result in loss of Scavenger AI access. You may revoke a connected third-party provider's access at any time from that provider's settings.
• We reserve the right to suspend or terminate accounts that abuse the Service, including automated access, scraping, sharing accounts, or violating these terms.

6. Subscriptions and Billing

Some Scavenger AI features require an active paid subscription tier. By subscribing you agree to the following:

• Subscriptions renew automatically at the interval shown at the time of purchase until you cancel.
• Pricing, included features, and entitlement limits may change. We will communicate material changes before they take effect on a renewal.
• You may cancel future renewals at any time. Cancellation stops future billing but does not retroactively refund completed billing periods, except where required by law.
• All payments are processed by a third-party payment provider. Scavenger AI does not store full card numbers.
• Refunds are handled on a case-by-case basis and at our reasonable discretion. We may decline refunds where access has been actively used, terms have been violated, or applicable consumer-protection laws do not require one.
• We may suspend or terminate access without refund for serious violations, including scraping, account sharing, chargeback fraud, or other abuse.

7. Watchlists and Alerts

Scavenger AI offers in-app and notification-based alerts for monitored items, saved deals, free-food offers, and high-priority opportunities. By opting in you acknowledge:

• Alerts are best-effort and not guaranteed. Delivery depends on third-party infrastructure and factors outside our control. We are not liable for missed, delayed, duplicated, or undelivered alerts.
• Deal prices, penny statuses, free-food availability, and inventory can change at any time. An alert does not guarantee that an item will still be available, in stock, free, or at the stated price when you act on it.
• You can disable alerts at any time through the in-app settings without affecting the rest of your account.
• We reserve the right to suspend alert access for accounts that appear to be abusing the alert system (for example, mass-saving items solely to generate high notification volume).

8. Free Food and Promotional Offers

Scavenger AI may surface free-food deals, freebies, samples, coupons, and similar promotional offers from third-party retailers, restaurants, brands, and partners ("Free Offers"). Free Offers are provided for reference and convenience only.

• Free Offers are controlled by the retailer, restaurant, brand, or partner that issues them — not by Scavenger AI. They may be limited in quantity, time-restricted, regional, account-restricted, or subject to additional terms set by the issuer.
• We do not guarantee that any Free Offer is currently active, valid in your area, available in stock, or that it will be honored. Offers can expire, sell out, or change without notice.
• You are responsible for reviewing and complying with the issuer's terms, eligibility requirements, and any purchase or membership conditions tied to a Free Offer.
• Scavenger AI is not responsible for offers that are refused, expired, regionally unavailable, or otherwise not honored, and is not liable for any cost, travel, or inconvenience incurred in pursuit of a Free Offer.

9. No Guarantee of Availability or Results

We do not guarantee that any product, price, deal, penny-status indicator, free-food offer, or promotion shown in Scavenger AI will be available, honored, or purchasable at any store. Retailers may change prices, inventory, or policies at any time without notice. Penny items in particular are never guaranteed until scanned at self-checkout.

10. Affiliate Disclosure

Scavenger AI participates in affiliate marketing programs. Certain outbound links may be monetized, and we may earn a commission when you click a link or make a qualifying purchase.

• Commissions are paid by the retailer or affiliate partner, at no additional cost to you.
• Affiliate relationships do not influence which deals or data are displayed.
• Your use of the Service constitutes acknowledgment that some outbound links may be affiliate links.

11. Limitation of Liability

To the fullest extent permitted by law, Scavenger AI and Scale Ventures LLC shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the Service. This includes, but is not limited to, losses resulting from:

• Incorrect or stale pricing, inventory, penny-status, or free-food information.
• Unavailable products, refused sales, expired offers, or store-policy refusals.
• Wasted travel, fuel, time, or missed opportunities.
• Missed, delayed, or undelivered alerts.
• Reliance on any data, score, prediction, or indicator displayed in the Service.

You use Scavenger AI at your own risk and assume full responsibility for decisions made based on the data it presents.

12. Intellectual Property

All content, branding, design, data presentation, code, and other materials within Scavenger AI are the property of Scale Ventures LLC or its licensors and are protected by applicable intellectual property laws. Unauthorized reproduction, scraping, mirroring, redistribution, or commercial reuse is prohibited.

Third-party trademarks, including retailer names and logos, are the property of their respective owners and are used for identification purposes only.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, abuse the Service, or pose a risk to other users or to the platform. You may stop using the Service at any time by closing your account or requesting account deletion.

Sections that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property) will continue to apply after termination.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, post a notice in-app or through the Scavenger AI community. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to conflict-of-law principles. You agree that any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Michigan.
